Only new Members who enroll in a particular month will be entitled to enter the draw
for that particular month’s monthly draw. All draws will be judged by a panel of senior
executives of the Fullerton India.

FULLERTON INDIA PRIVILEGE PROGRAM MEMBERSHIP - TERMS AND CONDITIONS
These terms and conditions set out the contractual relationship between Fullerton India (defined hereinafter) and
each individual Member (defined hereinafter) of the Fullerton India Privilege Program. Each Applicant is advised to
read these Terms and Conditions prior to making an application for membership of the Fullerton India Privilege
Program. Further, Members are advised to read these Terms and Conditions before using and quoting the Fullerton
India Privilege Program Membership number to Fullerton India or any Program Partner of Fullerton India
Definitions
In these Terms and Conditions, unless the context otherwise requires, the following terms shall have the same
meaning as set out hereinafter:
'Applicant' means any individual who has duly filled and has submitted the Fullerton India Privilege Program
enrolment form to the Fullerton India branch office/centre for becoming the member.
'Data' means information personal to a member including, without limitation, name, address, telephone number,
date of birth, employer, contacts with Fullerton India or any other information received from a Program Partner as
a result of using services provided by the Program Partners and/or other related data as may be disclosed by
Fullerton India and its Program Partners from time to time.
'Fullerton India’ means Fullerton India Credit Company Limited.
'Member' means a person who has been accepted as a member of the Fullerton India Privilege program and who
has been issued a Membership No.
‘Membership’ means membership of the Fullerton India Privilege Program.
‘Program Partners’ means any manufacturer, company, vendor or organization designated as a program partner in
relation to the Fullerton India Privilege Program by Fullerton India from time to time.
‘Fullerton India Privilege Program' means the Fullerton India Privilege Program, managed and operated by Fullerton India, offering benefits, facilities or arrangements to Members by reason of their membership in the
program.
'Fullerton India Privilege Card' and 'Membership Card' mean a membership card issued by Fullerton India to an
Applicant.
Membership
Membership to the Fullerton India Privilege Program is open to all Applicants. The membership is
voluntary. In case the Membership application is by a company, partnership firm, unincorporated
associations or similar entities, the company partnership firm or unincorporated associations, such entities
shall not be eligible for Membership unless they nominate any of their director, partner, governing member
or any other nominee as Member of the Fullerton India Privilege Program and such person shall personally
be entitled to all the benefits under the Fullerton India Privilege Program and the same shall not be
transferable to any other person or member of such entity unless expressly approved by Fullerton India in
writing.
An Applicant shall only be a Member upon communication of the Applicants acceptance into the Fullerton
India Privilege Program by Fullerton India.
Membership to Fullerton India Privilege Program is offered at the discretion of Fullerton India. Refusal or rejection of any application for membership or for renewal will be at the sole and absolute discretion of
Fullerton India and all such decisions shall be final and binding on the Applicants and Members as the case
may be.
To apply for Membership, the Applicant must complete the Fullerton India Privilege Program enrolment
form and return it to Fullerton India along with payment of the applicable fee. The period of Membership
shall be deemed to have commenced as soon as the Fullerton India Privilege Member has been issued
Fullerton India Privilege Program Membership number.
The Member confirms that he/ she has read and understood the terms and conditions of the Fullerton India Privilege Program and upon submission of the Application, agrees to be bound by such terms and
conditions.
A Fullerton India Privilege Program Membership card is valid only for use during the period indicated on it
and/ or if no validity is expressly stated, then till the validity of Membership. The Membership will be valid
for a period of one year from the date of issuance of the Membership Card.
A Fullerton India Privilege Program Membership card is not transferable and is not a credit card. Fullerton
India Privilege Program membership numbers are non-transferable. The Membership does not entitle the
Member for any privileges or rights from or against Fullerton India or its Program Partner on its products
and services except those communicated and/or announced, from time to time, by Fullerton India, in
connection to such Membership.
If lost, the Fullerton India Privilege Program Membership card will be reissued by Fullerton India upon
receiving a written request from the Member, on a replacement fee of Rs. 500 payable by cheque to
Fullerton India Credit Co. Ltd.
A person may be enrolled to a Fullerton India Privilege Program Membership regardless and independent
of any earlier Membership by the same Member to the Fullerton India Privilege Program.
Misuse of products, benefits, facilities or arrangements membership cards or program benefits may result
in termination of membership or withdrawal of benefits at the discretion of Fullerton India.
The Fullerton India Privilege Program Membership Card remains at all times the property of Fullerton India, which reserves the right at any time in its absolute discretion and without giving notice to such Member to
refuse membership or to revoke Membership. The Member must return his/her Fullerton India Privilege
Program Membership Card within 15 working days whenever requested by Fullerton India.
While Fullerton India will endeavor to see that the services, benefits, facilities and arrangements as communicated, expressed or advertised by Fullerton India and/or the Program Partners is available to the
Members, Fullerton India and the Program Partner will not be liable for any loss or damage, whether direct
or indirect, arising from the provision or non-provision, whether whole or part, of any such products,
services, benefits, facilities or arrangements.
When a Member seeks to use or obtain any of the services, benefits, facilities or arrangements offered, the provision of such services, benefits, facilities or arrangements will be subject to the respective terms and conditions of the manufacturer/vendor/provider of said products, benefits, facilities or arrangements as and when offered. Each of the mentioned products, benefits, facilities or arrangements may be subject to
terms and conditions specific to such product, benefit, facility or arrangement and the Member agrees to
read and understand all such terms and conditions before using or obtaining the said benefits.
A Member must quote his/her membership number as mentioned on his/her card when seeking any
services, benefits, facilities or using the services of a Program Partner. If a Member fails to provide the
required membership information accurately Fullerton India or Program Partner shall be entitled to refuse
the grant of services, benefits or facilities and no claim or remedy shall lie against Fullerton India or such
Program Partner for such refusal.
Enrolment
An application to join the Fullerton India Privilege Program deems acceptance on the part of the Member of all the Terms and Conditions herein.
Any Applicant may apply to enroll into the Fullerton India Privilege program through an 'Enrolment Form'. Membership however, is not confirmed until the duly filled Enrolment Form has been accepted and processed by Fullerton India and acceptance of application and a membership no. has been issued to the Member. Fullerton India will communicate the Membership number by a welcome letter and a Membership Card.
An Applicant for Membership must supply all of the information required in the Enrolment Form and any other information as may be required by Fullerton India in connection with the Fullerton India Privilege Program.
The personal information the Member has provided in the Application form/Enrolment Form or will provide as a Fullerton India Privilege Member:
will be retained and used by Fullerton India to ensure the efficient running of the Program;
may be disclosed as required by law;
may be used by Fullerton India to send the Member communications about promotions, services, products and facilities offered by Fullerton India;
may be disclosed to a Program Partner of the Fullerton India Privilege Program to assist that Program Partner in the planning and development of the Fullerton India Privilege Program;
may be used by Program Partners to send separate communications about services, products and facilities offered by that Program Partner;
may otherwise be used in a manner which Fullerton India may deem fit.
Updating Account Information
It is the responsibility of the Member to advise Fullerton India of any changes in his/her name, address or preferences in writing. No claims shall be made against Fullerton India by any Member for non-receipt of
information arising out of a change in any details of the Member which has not been communicated to
Fullerton India in the manner specified herein.
Name change requests can only be made, if a written request is sent to Fullerton India, duly signed by the Member quoting his/her Membership Number.
Requests for changes in name should be accompanied by supporting documentation, as may be specified
at the time of making the change request.
Membership Status and Level Evaluation
The Fullerton India Privilege Program comprises of the Fullerton India Privilege Program Blue, Orange,
Silver, Silver Plus, Gold, Platinum, Diamond, Diamond Plus & Titanium levels. The Membership level will
depend upon the selection of level by the Applicant and the corresponding Enrolment fee being paid. For
each level the Membership fee will vary. The Membership fee is non refundable irrespective of the time
when an individual ceases to be the Member of the Fullerton India Privilege Program. The benefits and
privileges may also vary with level and Membership Status.
The Membership level structure and the fee payable currently are as under. Enrolment fee is subject to
change from time to time.

Subject to Applicant consenting for deduction of the Membership fee out of the loan amount sanctioned,
the Membership fee will be deducted out of the loan amount sanctioned. Membership fee can also be paid
separately by payorder/demand draft favoring Fullerton India Credit Company Limited.
At the time of submitting the Application for Membership, Fullerton India will conduct a skill based exercise/contest for the Applicant in which any Applicant may choose to participate. Winners of the skill based exercise/contest, who are also accepted for Membership by Fullerton India, shall be eligible for prize/gift declared by Fullerton India. In case of several Members becoming eligible for in the contest, the company will declare the final winner by draw of lots. Only new Members who enroll in a particular month will be entitled to enter the draw for that particular month’s monthly draw. All draws will be judged by a panel of senior executives of the Fullerton India.
Any tax or liabilities or charges payable to the government or any other authority or body, if any, which may arise or accrue due to any prize/gift, shall be borne directly by the Member. Fullerton India may deduct any
tax at source, as applicable, in relation to any prize, and shall be to the account of the Member on the
maximum retail price of the prize/gift which includes all applicable sales tax and other levies. The
prizes/gifts, if any, offered under this scheme are non-transferable and cannot be encashed. No
substitutions or exchange of prize shall be allowed. However the Company reserves the right to substitute
and/or change the prize or any of them on account of non availability of the prize without any intimation or
notice, written or otherwise.
Non-submission of the tax amount within 15 days of the receipt of the communication letter would result
in forfeiture of the gift/prize voucher
Fullerton India makes no warranties or representations, either expressed or implied, with regard to the type
or quality of the prize/gift provided or that may be provided by Fullerton India or its Program Partners under
the Fullerton India Privilege Program. Fullerton India has no liability for the acts or omissions of its Program
Partners. Fullerton India shall not be liable on account of any deficiency or defect in the products given as
prizes/gifts to any Member. Fullerton India has no liability for the acts or omissions of its Program Partners.
The Member acknowledged and agrees that any claim for compensation, damages or any other remedy arising on account of any products offered to any Member in relation to the Fullerton India Privilege
Program shall lie against the Program Partners/ Manufacturers/ Service providers and no Member shall seek
to raise any claim against Fullerton India in relation to the same.
Discount Offers
From time to time, the Fullerton India Privilege Program may offer its members discount offers, which will
entitle the Member to purchase products at discounted rate.
Based on the level, Fullerton India Privilege Blue, Orange, Silver, Silver Plus, Gold, Platinum, Diamond,
Diamond Plus & Titanium Members may receive discount offers respectively, which will entitle them to
benefits and facilities as may be declared by Fullerton India from time to time.
Any discount offers issued by Fullerton India or Program Partner will be governed by the Terms and
Conditions contained in such offer.
Any discount offer will be valid for such period as may be notified by Fullerton India or the Program Partner
in relation to said offer. The discount offer must be used within the validity period mentioned on such offer.
In an effort to provide offers to Members, Fullerton India may develop mailing lists for use by themselves
and their Program Partners. These lists will be based on information provided by the Member at the time of
enrolment. Members will be sent e-mail and/or SMS communication based on their consent given at the
time of enrolment. If a member does not wish to receive these offers, he/she may request in writing to have
his/her name removed from the said mailing lists by contacting Fullerton India Branch office. Withdrawal of
consent may mean that certain services may no longer be provided to the member.
If Program Partner, their outlets, dealers or franchise suppresses or discontinue any promotional offer, then Fullerton India shall not be held liable for loss or damage arising out of or in connection with suppression or discontinuation of the offer by the Program Partners or any of their dealers, franchise.
Termination of Membership
If the Member wishes, he/she may terminate his/her Membership by writing to Fullerton India. Any such termination does not relieve the Member of any continuing obligations under these terms and conditions.
The Member will not be entitled for any refund of enrolment or renewal fee or part thereof due to
termination.
Fullerton India reserves the right at any time in its absolute discretion to terminate the Membership of any member and/or the right of any Member to use the Fullerton India Privilege Membership card if a member
commits fraud or misconduct. Fullerton India will write to such a Member stating their Membership is being
terminated for this reason. Upon the death of a Member, the Fullerton India Privilege membership will be
closed.
Change/termination of the Fullerton India Privilege program
Membership enrolment and eligibility are subject to the terms and conditions of the Fullerton India
Privilege Program and are subject to any applicable laws and regulations. Fullerton India may at any time,
without giving notice, change the Fullerton India Privilege level structure, change or withdraw Program
Partners' affiliations, introduce and or review membership fees, stop enrolment of new member and/or
modify the procedures and rules relating to services, benefits, facilities or other aspects of the Fullerton
India Privilege program.
Fullerton India may also change, add to, modify or withdraw at any time, without giving notice, such terms
and conditions as well as any benefits provided in connection with the Fullerton India Privilege Program
and any special offers or promotional offers made to any level or group of Members. The decision of
Fullerton India will be final and conclusive in this regard.
Fullerton India and its Program Partners reserve the right to change Fullerton India Privilege Program rules, regulations, awards and special offers at any time without notice.
Notwithstanding anything contained herein above, Fullerton India may terminate the Fullerton India
Privilege program at any time but will use its reasonable endeavors to give at least fifteen[15] days notice
to Members. At the end of the period of notice, each member acknowledges that his/her right to use the
services and benefits will cease.
Limitation of Liability
Fullerton India and/or its Program Partners shall not be liable to any Member or any other person for any
direct, indirect or consequential loss, damage or expense of any kind whatsoever, arising out of or in
connection with the Fullerton India Privilege Program and/or the change of or to the Fullerton India
Privilege Program or the refusal or withdrawal to provide any benefits or facilities or limiting of any such
services, benefits or facilities, whether such loss, damage or expense is caused by the negligence or
otherwise, and whether Fullerton India and/or its Program Partners have any control over the
circumstances giving rise to the claim or not.
Fullerton India will endeavour to ensure the availability of services provided by Program Partners but will
not be liable for any loss arising from the failure by Program Partners to provide services.
Dispute Resolution
These terms and conditions shall be governed by and construed in accordance with Indian law. In the event of disputes, controversies, differences of opinion and claims arising out of or in connection with Fullerton
India Privilege Program or in any way relating hereto or any term, condition or provision herein
mentioned or the construction or interpretation thereof or otherwise in relation hereto, Fullerton India and
Member shall first endeavor to settle such differences, disputes, claims or questions by friendly
consultation and failing such settlement, the same shall be referred to Arbitration of sole Arbitrator, to be
appointed by Fullerton India for determination of specific issues/disputes. Such arbitration shall be held in
accordance with the Arbitration and Conciliation Act, 1996 or any statutory modification or re-enactment
thereof for the time being in force and shall be held in Mumbai and be conducted in the English language.
Subject to the provisions of this clause, for matters referable to civil court, Fullerton India and each Member
submit to the exclusive jurisdiction of the competent courts at Mumbai.
The Fullerton India Privilege Program shall be subject to usual force majeure events and on occurrence of such event, the scheme shall deem to be automatically withdrawn.
